The Undersigned Grantor hereby grants to Stichting ’s-Hertogenbosch Muziekstad (www.vocalcompetition-ivc.tv) and Zappabach.tv the exclusive, unlimited, worldwide, unconditional and irrevocable right and his/her permission to make recordings of his/her performance in the framework of the International Vocal Competition ’s-Hertogenbosch; to make the above available to the public, whether or not in edited form; to reproduce, sell, rent, lend, supply or otherwise distribute to the public or put into circulation or for any of the purposes mentioned above, to offer for sale or to store; to broadcast or cause to be broadcast and to repeat broadcast or cause to be repeated or to otherwise exploit in whatsoever way now known or in the future devised, which in all events includes but is not deemed to be limited to the following: the right of Stichting ’s-Hertogenbosch Muziekstad and Zappabach.tv of fixation of the Recording in whole or in part, whether in edited or unedited form or by means of adaptation or synchronization, the right to make copies, to issue said copies to the public and/or the right to reproduce the above on its website(s) and/or via antenna, cable, satellite, computer, and telecommunication systems and/or by any other means of (3G) technology systems, analogue or digital, hereafter devised, which includes but is not limited to IPTV, (broadband) Internet, mobile Internet, WiFi, mobile telephony (GSM, GPRS/Edge, UMTS) and/or fixed line telephony, interactive television, video on demand, pay TV and/or closed circuit television, pay per view channels, webcasting, narrow casting, single casting, DTT, DVB-S, DVBB, DVB-T, DVB-H, free television, carrousel channels and further any and all radio and print media now known or in the future devised. The Undersigned within the framework of the provisions set out in the present Clause hereby transfers his/her rights to Stichting ‘s-Hertogenbosch Muziekstad and Zappabach.tv.

Insofar as there are any Intellectual Property rights, including copyright, and/or Neighbouring Rights, which are exercisable by the Undersigned in the execution of his/her activities pursuant to the present Agreement, the Undersigned upon signing same Agreement hereby assigns said rights completely, exclusively, unlimitedly, and unconditionally to Stichting ’s-Hertogenbosch Muziekstad and Zappabach.tv, which assignment is duly accepted by Stichting ’s-Hertogenbosch Muziekstad and Zappabach.tv. The Undersigned hereby waives as far as possible the rights set out in Article 5 paragraph 1 subparagraphs a, b and c of the Neighbouring Rights Act (Wet op de Naburige rechten) and waives the rights set out in Article 25 paragraph (1) subparagraphs (a), (b) and (c) and in Article 45 paragraph (1) subparagraphs (a), (b) and (c) of the Copyright Act 1912. As a result of the above assignment Stichting ’s-Hertogenbosch Muziekstad and Zappabach.tv are entitled to the unlimited, worldwide, unconditional, perpetual, and exclusive exploitation of the rights mentioned above, as well as being entitled to assign said rights to a third party, including a television channel and or any Sponsor systems connected to the Recording.

The Undersigned does not stipulate any payment for consideration in respect of his/her cooperation, permission and transfer as mentioned under (1), (2) and (3) or in respect of the further performance of the present Agreement in its entirety, nor shall Undersigned do so in the future. The Undersigned hereby also waives any and all rights to an equitable remuneration therefor in the future. Stichting ’s-Hertogenbosch Muziekstad and Zappabach.tv are not liable to pay costs (including travelling expenses) incurred by the Undersigned for his/her cooperation in the Recording, unless otherwise agreed in writing.

The present Agreement is governed by the Laws of the Netherlands.
